DEVELOPING A NATIONAL ACTION PLAN (NAP) FOR PRIVATE SECUIRTY GOVERNANCE REFORM IN NIGERIA PROJECT

 (2024)

About the Project: The Developing a National Action Plan for Private Security Governance Reform in Nigeria Project was implemented by African Law Foundation (AFRILAW) in partnership with Nigeria Security and Civil Defense Corps (NSCDC) with funding support from the Geneva Center for Security Sector Governance (DCAF) Switzerland through the UK Foreign, Commonwealth and Development Office (UK FCDO). The project seeks to raise awareness of key stakeholders on private security and human rights and on international good practices linked to private security governance. The capacity-building activities will lead to the adoption of a private security and human rights action plan to inform and guide key stakeholders in good private security governance. The aim of the project was to support the Nigerian private security regulator to develop a National Action Plan for Private Security Governance Reform through multi-stakeholder consultation. The Objective of the Programme is to create the roadmap for private security governance reform in Nigeria through the development of a national action plan in partnership with key federal government policymakers and key national stakeholders. The Developing a National Action Plan for Private Security Governance Reform in Nigeria Project was implemented from January to March 2024 (3 Months).

However, the NAP Project activities was reviewed by AFRILAW with DACF approval in February 2024 because of red-tape and bureaucracy from the Ministry of Interior which was delaying the commencement. The reviewed activities focused mostly on organizing the Multi-stakeholders’ consultations on the NAP, drafting the NAP and submit the NAP to NSCDC.

THE PROJECT ACTIVITIES: 

  • 1-DAY CSO/MEDIA WORKSHOP ON PRIVATE SECUIRTY GOVERNANCE REFORM HELD ON WEDNESDAY MARCH, 13, 2024 AT NEWTON PARK HOTEL ABUJA.

African Law Foundation (AFRILAW) in partnership with Nigeria Security and Civil Defense Corps (NSCDC) with funding support from the Geneva Center for Security Sector Governance (DCAF) Switzerland through the UK Foreign, Commonwealth and Development Office (UK FCDO) implemented the CSO/Media workshop on private security governance reform. The aim of this workshop is to engage and sensitize key and relevant stakeholders on private security governance reform and for them to make valuable inputs and recommendations for the development of the draft National Action Plan on Private Security Governance Reform in Nigeria. The Objective of the Workshop is to discuss the challenges of private security governance and make valuable recommendations for effective reform in Nigeria through multistakeholder consultation. We had CSOs from various States who flew into Abuja a day before the workshop, States such as Kano, Lagos, Calabar, Enugu, Port-Harcourt, among others to attend the workshop. We had in attendance a total of Thirty-five (35) participants. The Participants engaged in the group works using a flip chat sheets to write down their input, recommendations and suggestions.

  • 1-DAY PRIVATE SECURITY COMPANIES WORKSHOP ON PRIVATE SECUIRTY GOVERNANCE REFORM HELD ON MONDAY MARCH, 18, 2024 AT NEWTON PARK HOTEL ABUJA.

  • 1-DAY MDAs AND POLICYMAKERS WORKSHOP ON PRIVATE SECUIRTY GOVERNANCE REFORM HELD ON THURSDAY MARCH, 21, 2024 AT NEWTON PARK HOTEL ABUJA.

African Law Foundation (AFRILAW) in partnership with Nigeria Security and Civil Defense Corps (NSCDC) with funding support from the Geneva Center for Security Sector Governance (DCAF) Switzerland through the UK Foreign, Commonwealth and Development Office (UK FCDO) implemented the MDAs and Policymakers workshop on private security governance reform. The aim of this workshop is to engage and sensitize key and relevant stakeholders on private security governance reform and for them to make valuable inputs and recommendations for the development of the draft National Action Plan on Private Security Governance Reform in Nigeria. The Objective of the Workshop is to discuss the challenges of private security governance and make valuable recommendations for effective reform in Nigeria through multistakeholder consultation. The workshop was attended by participants from diverse MDAs in Abuja such as National Human Rights Commission (NHRC), the Independent Corrupt Practices and Other Related Offences Commission (ICPC), The Nigeria Police Force among others. We had in attendance a total of Nineteen (19) participants. The Participants engaged in the group works using a flip chat sheets to write down their input, recommendations and suggestions.

  • DEVELOPING AND SUBMISSION OF THE DRAFT NAP FOR STAKEHOLDERS VALIDATION TO AFRILAW FOR REVIEW:

Upon conclusion of the three multi-stakeholder’s consultations on private security sector governance reform workshops implemented by African Law Foundation in partnership with Nigeria Security and Civil Defense Corps (NSCDC) with funding support from the Geneva Center for Security Sector Governance (DCAF) Switzerland through the UK Foreign, Commonwealth and Development Office (UK FCDO), the Consultant developed the draft National Action Plan template by collating the inputs and recommendations from the three multi-stakeholder’s consultation workshops. He then after submitted the draft NAP to AFRILAW Project Team for review and use during the implementation of the National Stakeholders Validation Workshop.

  • 1-DAY NATIONAL STAKEHOLDERS’ VALIDATION WORKSHOP ON PRIVATE SECURITY GOVERNANCE REFORM HELD ON MARCH 27, 2024 AT NEWTON PARK HOTEL, FCT- ABUJA.

African Law Foundation (AFRILAW) in partnership with Nigeria Security and Civil Defense Corps (NSCDC) with funding support from the Geneva Center for Security Sector Governance (DCAF) Switzerland through the UK Foreign, Commonwealth and Development Office (UK FCDO) implemented the National Stakeholders, Validation Workshop on Private Security Governance Reform. The Objective of the National Stakeholders Validation Workshop is to validate the draft report and action plan developed from the recent multi-stakeholder’s consultation on private security governance reform events carried out by African Law Foundation (AFRILAW) in partnership with Nigeria Security and Civil Defense Corps (NSCDC).  The workshop was attended by participants from diverse CSOs/Media, MDAs and Private Security Companies. Some key MDAs that attended included Department of State Security Services (DSS), the office of the National Security Adviser (ONSA), the Economic and Financial Crimes Commission (EFCC), the Nigerian Correctional Service (NCS), the Nigerian Police Force (NPF) among others. We had in attendance a total of Forty-six (46) participants. The Participants engaged in the group works using a flip chat sheets to write down their input, recommendations and suggestions.

KEY PROJECT ACHIEVEMENTS:

  • The NAP Draft Template on Private Security Sector Governance Reform was developed for the multi-stakeholder’s consultation workshops.
  • Key and relevant stakeholders were well engaged and sensitized at the multi-stakeholder’s consultations on private security governance reform 
  • Key and relevant stakeholders made relevant good inputs and recommendations at the multi-stakeholder’s consultations for the development of the draft National Action Plan on Private Security Governance Reform in Nigeria.
  • The Draft Report and Action Plan developed from the multi-stakeholder’s consultation on private security sector governance reform was validated by key and relevant stakeholders.
  • The development of the final Draft of the NAP on Private Security Sector Governance Reform and its submission to NSCDC for any further action and implementation.

INTEGRATING PRIVATE SURVIELLANCE REGULATION WITHIN THE FRAMEWORK OF THE NATIONAL ACTION PLAN FOR PRIVATE SECUIRTY GOVERNAMNCE REFORM IN NIGERIA PROGRAMME

 (JANUARY-FEBUARY 2024)

About the Programme: The Integrating Private Surveillance Regulation within the framework of the National Action Plan for Private Security Governance Reform in Nigeria Programme was implemented by African Law Foundation (AFRILAW) in partnership with the, Geneva Center for Security Sector Governance (DCAF) Switzerland, Nigeria Security and Civil Defense Corps (NSCDC) with funding support by UK FCDO and FDFA. The goal of this Programme is the need for effective regulatory framework for private surveillance services within the private security industry in other to ensure adequate data protection and fundamental human rights are protected in Nigeria. The key objective of the programme is to engage private security policymakers and stakeholders toward the integration of private surveillance regulation within the National Action Plan for private security governance reform process in Nigeria.The Nigeria Private Surveillance Regulation Programme was implemented from January 26 to February 1, 2024.

THE PROJECT ACTIVITIES: 

  • NIGERIA SECUIRTY AND CIVIL DEFENSE CORPS (NSCDC) LAW REVIEW MEETING:

African Law Foundation (AFRILAW) in partnership with the Geneva Center for Security Sector Governance (DCAF) Switzerland with funding support by UK FCDO and FDFA facilitated a 3 (Three) Days Nigeria Security and Civil Defense Corps (NSCDC) Law review meeting. The aim of this meeting was to review the Nigeria Private Security Industry Bill 2024 which is to repeal the existing Private Guards Companies Act of 1986 regulating the licensing of Private Guard Companies in Nigeria. The reviewed Bill would thereafter be presented to the office of the Minister of Interior for further review.

  • DAY 1 OF THE NSCDC LAW REVIEW MEETING HELD ON FRIDAY JANUARY 26 2024 AT TOP VIEW HOTEL, FCT- ABUJA: 

We had in attendance participants from relevant departments of the Nigeria Security and Civil Defense Corps (NSCDC) as well as the representative of the Attorney General of the Federation (AGF) from the Federal Ministry of Justice. The meeting materials which comprised of the Bill sought to be reviewed, jotters and pens were shared to all participants. The review meeting was chaired by the ACG-PGC NSCDC and we had in attendance a total of Eighteen (18) participants.

The meeting had in attendance a total of Nineteen (19) participants. The representative of DCAF Ms Gabrielle Priklopil participated physically.  The ACG-PGC led the review meeting and they continued from the section of the Bill they stopped at the previous meeting.   • PRIVATE SURVILLANCE FOR PRIVATE SECUIRTY ROUNDTABLE AND LUNCH MEETING HELD ON WEDNESDAY JANUARY 31, 2024 AT NEWTON PARK HOTELS & RESORTS, FCT-ABUJA:

The Private Surveillance for Private Security Roundtable and Lunch Meeting was held on January 31, 2024 at Newton Park Hotels & Resort, FCT-Abuja. There were about twenty-four (24) participants which comprised of key private security policymakers and stakeholders such as the Federal Ministry of Interior, National Human Rights Commission (NHRC), National Institute for Legislative & Democratic Studies (NILDS), the Nigerian Police Force (NPF), National Identity Management Commission (NIMC), Nigerian Communication Commission (NCC), Nigeria Security and Civil Defence Corps (NSCDC) officers which included the Assistant Commandant General ACG-PGC, The ALPSPN, the DCAF representative Ms Gabrielle Priklopil attended physically as well,  media and AFRILAW Staff.

THE NIGERIA PRIVATE SURVEILLANCE REGULATION PROGRAMME (2024)

About the Proramme: The Nigeria Private Surveillance Regulation Programme was implemented by African Law Foundation (AFRILAW) in partnership with the, Geneva Center for Security Sector Governance (DCAF) Switzerland, Privacy International (PI), Nigeria Security and Civil Defense Corps (NSCDC) with funding support by UK FCDO and FDFA. AFRILAW facilitated Three (3) different capacity building workshops on Private Surveillance Regulation and Data Protection for CSOs/Media, MDAs/Policymakers and Private Security Companies. The objective of this capacity building workshops is to train and build the capacity of relevant private security industry policymakers, stakeholders and Private Security Companies on Private Surveillance Regulation and Data Protection towards effective private security industry regulatory reform and transformation in Nigeria. Upon conclusion of the capacity-building workshops, AFRILAW also facilitated a 2-Days Strategic Meeting on Private Surveillance and Data Protection Regulation with the NSCDC Law Reform Committee. The objective of this meeting was to provide technical support and assistance to NSCDC Private Security Law Review Committee integration of Private Surveillance and data protection within the ongoing private security regulator and law reform process in Nigeria. Dr. Ilia Siatitsa, the Programme Director and Senior Legal Officer, Privacy International visited Nigeria for this programme as she was to make the key presentations during the capacity-building workshops. The Nigeria Private Surveillance Regulation Programme was implemented from April 15 to April 19, 2024.

Key Results & Achievements:  

  • At least 40 CSOs/Media organizations were trained and built their capacity on private surveillance regulation and data protection towards effective private security industry regulatory reform and transformation in Nigeria.
  • At least 30 MDAs and Policy makers were trained and built their capacity on private surveillance regulation and data protection for effective private security industry regulatory reform and transformation in Nigeria.
  • A least 30 Private Security Companies were trained and built their capacity on private surveillance regulation and data protection for effective private security industry regulatory reform and transformation in Nigeria.
  • Technical support and assistance was given to the NSCDC Law Reform Committee integration of private surveillance and data protection within the ongoing private security regulatory and law reform process in Nigeria.
  • Private Surveillance and Data Protection provisions were explicitly captured in the NSCDC proposed reviewed bill.
  • Proposed key Inter-Agency Collaboration and Partnership between agencies such as NDPC and the Regulators NSCDC.
  • Proposed assistance in the development of industry guidelines for the restructuring of the private security industry.
  • Proposed training support on best standards and practices stemming from the Inter-Agency Collaboration and Partnerships.

THE NIGERIA RESPONSIBLE PRIVATE SECURITY COMPANY TRAINING PROGRAMME (2022-2023)

About the Programme: AFRILAW in collaboration and in partnership with the International Code of Conduct Association (ICoCA) Switzerland, Geneva Center for Security Sector Governance (DCAF) Switzerland, MSS Global UK, Nigeria Security and Civil Defense Corps (NSCDC) with funding support by UK FCDO initiated and implemented the Nigeria Responsible Private Security Company Training Programme. The goal of this project is to provide capacity building and training to Nigeria Private security companies on existing obligation and best practices for improved standards of operations, excellent service delivery and professional conducts and effective private security governance and management system. 

The key objectives of the training programme are; increasing awareness and knowledge on existing obligation and best practices, gain specific expertise on inter sectional thematic areas of use of force, gender equality and preventing sexual exploitation and abuse. Get support for long-term development of a culture that respects and seeks to protect human rights within their company and how to address human rights challenges in complex environments, integrate effective private security governance and management system, learn the benefits and how to become ICoCA member and get ICoCA certification. The pilot Nigeria Responsible Private Security Company Training Programme was implemented across 5 states of Nigeria from October 2022 to March 2023.

PROGRAMME ACTIVITIES IMPLEMENTED:

  • THE FLAG-OFF WORKSHOP ON THE NIGERIA RESPONSIBLE PRIVATE SECURITY COMPANY TRAINING:  

The Flag-off workshop on the Nigeria Responsible Private Security Company Training Programme was held on October 26th, 2022 at Top View Hotel, Abuja. There were about forty-five (45) participants including thirty (30) PSC representatives, seven (7) Nigeria Security and Civil Defense Corps (NSCDC) officers which included the Assistant Commandant General ACG-PGC, one (1) MSS Global representative, four (4) media personnel’s and three (3) AFRILAW staff.

  • THE 2ND FCT TRAINING WORKSHOP ON THE NIGERIA RESPONSIBLE PRIVATE SECURITY COMPANY TRAINING AND ICOCA MISSION TO NIGERIA:  

The 2nd Training Workshop of the Nigeria Responsible Private Security Company Programme was held on November 17th 2022 at Newton Park Hotel Resort, Abuja.  There were about thirty-two (32) participants which comprised of twenty-three (23) PSC representatives, two (2) Nigeria Security and Civil Defense Corps (NSCDC) officers, two (2) ICoCA representatives, one (1) MSS Global UK Representative, one (1) media personnel and three (3) AFRILAW staff. 

Mr. Giuseppe Scirocco and Mr Christopher Galvin representatives of the ICoCA team participated physically for this training workshop as they visited Nigeria to conduct their annual monitoring and assessment of the member Companies. The ICoCA Lunch Meeting with The FCT Zonal PSC Executives and Key Stakeholders of ALPSPN was held on November 18th, 2022 at Newton Park Hotel & Resort, Abuja.  There was about twenty-five (25) persons which comprised twenty (20) executives of various private security companies including the FCT Zonal Chairman, two (2) ICoCA representatives and (3) AFRILAW staff.

  • ICOCA VISIT TO NIGERIA SECURITY AND CIVIL DEFENSE CORPS (NSCDC):

  • TRAINING WORKSHOP FOR THE SOUTH-EAST REGION (ENUGU, ENUGU STATE|)

 

The Nigeria Responsible Private Security Company Training Programme training was held for PSC representative for the South-East region on January 27th, 2023 at Hotel Fidelma, Enugu, Enugu State with about Twenty-three– (23) participants, which includes Seventeen (17) PSCs representatives and NSCDC representatives. The participants were issued certificate of participation endorsed by NSCDC and AFRILAW.

  • TRAINING WORKSHOP FOR SOUTH-WEST REGION (LAGOS, LAGOS STATE)

The South-West training workshop on the Nigeria Responsible Private Security Company Training being implemented by African Law Foundation (AFRILAW) in partnership with the NSCDC, DECAF, MSS Global with funding from ICoCA. The training was held on February 9th, 2023 at Governors Hotel, Ikeja Lagos State, and there were about twenty-eight (28) participants with twenty-three (23) Private PSC representatives, three (3) NSCDC officers and two (2) AFRILAW staff. The (Zone A) ALPSPN Chairman, The National Secretary of the ALPSPN also represented the National President ALPSPN attended physically and the ACG-PGC NSCDC also attended physically representing the Commandant-General NSCDC and gave his goodwill remarks. The participants were issued certificate of participation endorsed by NSCDC and AFRILAW.

  • TRAINING WORKSHOP FOR SOUTH-SOUTH REGION (PORT-HARCOURT, RIVERS STATE:

The South-South Regional training workshop was held on March 2, 2023 at Aldgate Congress Resort, Port-Harcourt, Rivers State with about Thirty (30) participants including Twenty-seven (27) PSCs representatives and NSCDC representatives.  The participants were issued certificate of participation endorsed by NSCDC and AFRILAW.

The Programme Key Results and Achievements:

  • Increased awareness and knowledge of human right frameworks, ethics and code conducts relevant to private security services, existing obligation and international norms and best practices.
  • About participated 117 PSCs gained specific expertise on inter-sectional thematic areas of use of force, ICOCA and its Certification process, ethics and the code of conduct for private security service providers, human rights risk impact assessment, gender equality and preventing sexual exploitation and abuse.
  • The participated PSCs were assured of support for long-term development of a culture that respects and seeks to protect human rights within their company and how to address human rights challenges in complex environments.
  • There is a good promotion and highlights of integrated and effective private security governance and management system and responsible private security services in Nigeria
  • The participated PSCs learnt the benefits and how to become ICoCA member and get ICoCA certification in Nigeria and the level of support and services they can get from ICOCA and MSS Global in this regard.
  • Some participated PSCs expressed interest to join ICOCA and getting ICoCA certification.
  • The conduct of Courtesy Visit and 5 free Training Workshops for about 117 PSCs members of the Association of Licensed Private Security Practitioners of Nigeria (ALPSPN) in 5 states of Nigeria.
  • Participants confirmed that the training content is relevant to their work and expect that it strengthens respect of human rights within their companies and operations.
  • Some participated PSC expressed interest for AFRILAW support and partnership to conduct human rights risk impact assessment.
  • The ICoCA Team visit and meeting with the Commandant-General (CG) of the NSCDC and the CGs public support to ICOCA and expression of willingness to work toward and ensure Nigeria membership of ICoCA.

DEVELOPMENT AND PILOTING OF HUMAN RIGHTS TRAINING PROGRAMME BASED ON INTERNATIONAL NORMS AND GOOD PRACTICES (PRIVATE SECURITY HUMAN RIGHTS TRAINING WORKSHOP PROGRAMME) 

(JAN 2023- MARCH 2023)

About the Programme: AFRILAW and her partners Geneva Centre for Security Sector Governance (DCAF) Switzerland in coordination with the International Code of Conduct Association (ICoCA) Switzerland and the Association of Licensed Private Security Practitioners of Nigeria (ALPSPN) implemented the Development and Piloting of Human Rights Training Programme based on International Norms and Good Practices also termed as (Private Security Human Rights Training Workshop) with funding support by UK FCDO. The goal and aim of the project is to strengthen management and service delivery by Nigeria private security companies while reducing security and human rights risks and that this dedicated pilot human right training was successfully developed and piloted on a large scale within the Nigerian private security industry. The key objectives of the training programme are; increasing awareness and knowledge on Human Right frameworks relevant to Private Security Services, existing obligation and International best practices, gain specific expertise on inter sectional thematic areas of use of force, gender equality and preventing sexual exploitation and abuse. Get support for long-term development of a culture that respects and seeks to protect human rights within their company and how to address human rights challenges in complex environments, integrate effective private security governance and management system, learn the benefits and how to become ICoCA member and get ICoCA certification.

PROJECT ACTIVITIES IMPLEMENTED: 

  • PILOTING OF THE TRAINING PROGRAMME THROUGH AT LEAST 8 TRAININGS FOR REPRESENTATIVES OF AT LEAST 200 PRIVATE SECURITY COMPANIES IN EIGHT (8) STATES ACROSS THE GEOPOLITICAL ZONES IN NIGERIA.

THE TRAINING WORKSHOP PROGRAMMES CARRIED OUT INCLUDE:

  • FCT-ABUJA TRAINING WORKSHOP:

The FCT-ABUJA training workshop was held on January 23rd, 2023 at Newton Park Hotel & Resort FCT-Abuja. The workshop started by 9: 00am with the registration of attendance by the Private Security Companies senior executives and AFRILAW staff. The workshop materials comprised of a pen, jotter and the program agenda for all the participants. We had in attendance a total of thirty (30) persons which comprised of twenty-five (25) PSCs, two (2) media personnel and three (3) AFRILAW staff. FCT-Zonal Chairman of the ALPSPN was in attendance, the National President of the ALPSPN was the Chairman of the workshop and flagged off the training workshop not only in Zone I (FCT-ABUJA) but across the Nine (9) zones. The PLATEAU STATE training workshop was held on March 28th, 2023 at Valada Hotels and Resorts Jos, Plateau State. We had in attendance a total of thirty-eight (38) persons (Eight (8) female and thirty (30) male) which comprised of thirty-one (31) Private security senior executives, four (4) NSCDC officers and three (3) AFRILAW staff. RECOMMEDNATIONS/NEXT STEPS/FURTHER ACTION:

  • Seek for funding and expand the training programme to other States in Nigeria. The pilot training programme was done in 5 out of 36 states in Nigeria for about 117 out of more than 1000 registered PSCs in Nigeria.  
  • Develop and carry out a separated and specialized full day training programme on HRIA and PSEA for interested PSCs in Nigeria and support them in developing the required systems.
  • Develop Legislative Advocacy Programme for PS Industry Law Reform. There is need for new PSI regulatory framework in Nigeria.
  • Develop Nigeria ICOCA and MDF Membership Advocacy Programme to promote Nigeria official membership of ICoCA. There is a big support for Nigeria membership from NSCDC and ALPSPN and the need to build on the momentum. 
  • To encourage and provide necessary support to PSCs who expressed interest on conducting HRIA and developing some management and operational policies.
  • To encourage and provide necessary support to PSCs who expressed interest on the opportunities of joining ICOCA and getting ICOCA Certification. 
  • Partner with NSCDC and ALPSPN to develop and launch a National Code of Conduct for PSCs in Nigeria.
  • Partner with NSCDC and strengthen the capacity of the NSCDC in their Registration, Supervision, Monitoring and Documentation functions as the industry Regulator. 

PRIVATE SECURITY AND ELECTIONS IN NIGERIA PROJECT (2023)

About the Project: AFRILAW in collaboration with Nigeria Security and Civil Defence Corps (NSCDC), Association of Licensed Private Security Practitioners of Nigeria (ALPSPN) and International Code of Conduct Association (ICOCA), Switzerland in partnership of the Geneva Center for Security Sector Governance (DCAF), Switzerland with funding support from the UK FCDO initiated and implemented the The Private Security and Elections in Nigeria Project. The goal of the project is promoting election policy makers and stakeholders’ recognition, acceptance and support to private security participation and service delivery during elections in Nigeria and also build a road map for effective private security governance and regulatory reform in the electoral process in line with international norms and good practices in Nigeria during and after the 2023 elections. 

The key objectives of the project are; Convening political parties, policy makers, government stakeholders and CSOs to adopt resolutions on private security during elections; Ensuring that private security companies’ awareness and capacities to implement the resolutions are raised; Supporting CSOs monitoring of political parties, government and other stakeholders’ use of private security during 2023 elections and private security compliance with the resolutions with private security; and Holding a debrief with government stakeholders, political parties and civil society organisations and private security companies to compile the findings linked to private security and 2023 elections, with a particular focus on the need for regulatory reform and on the relevance of international good practice. The project was held from February-March 2023.

THE PROJECT ACTIVITIES:

  • NATIONAL STAKEHOLDERS FORA ON PRIVATE SECURITY AND 2023 ELECTIONS IN NIGERIA:
  • FIRST NATIONAL STAKEHOLDERS FORUM: 

The first 1-Day National Stakeholders Forum on Private Security and 2023 Elections in Nigeria was held on February 15th 2023 at Topview Hotel, FCT-Abuja with about 77 participants including the election and private security policymakers and stakeholder’s including federal government Ministries, Departments and Agencies including the National Human Rights Commission (NHRC) and NSCDC, ALPSPN Representatives led by its National President, CSOs and Media Organizations. There was a presentation and adoption of the draft Resolution on Good Private Security Governance during 2023 Election in Nigeria during the National Stakeholders Forum.

  • SECOND NATIONAL STAKEHOLDERS FORUM:

The 2nd 1-Day National Stakeholders Forum and Public Presentation of Report of Monitoring and Assessment of Private Security Services During 2023 Elections in Nigeria was held on March 31, 2023 at Topview Hotel, FCT-Abuja with about 62 participants including the key election and private security policymakers and stakeholder’s especially the representatives of the National Chairman of INEC and Office of the National Security Adviser to the President (ONSA). Other participants during the forum include representatives of including federal government Ministries, Departments and Agencies, NSCDC, ALPSPN Representatives, CSOs and Media Organizations. The Forum was Chaired by the Commandant General of NSCDC who also made the official presentation of the Report of Monitoring and Assessment of Private Security Services During 2023 Elections in Nigeria to the participants and the generals. The printed copies of the Report of Monitoring and Assessment of Private Security Services During 2023 Elections in Nigeria were distributed to the participants. 

Key highlight and result of the event is active participation and the public support and recommendation of PSC official engagement and participation in electoral process in Nigeria by representatives of the National Chairman of INEC and Office of the National Security Adviser to the President (ONSA).

  • PRODUCTION AND DISSEMINATION OF THE RESOLUTION ON GOOD PRIVATE SECURITY GOVERNANCE DURING 2023 ELECTIONS IN NIGERIA PAMPHLETS:

AFRILAW in collaboration with her partners produced the Resolution on good private security governance during 2023 elections in Nigeria pamphlets which was adopted at the first National Stakeholders forum. A total of about 700 copies of pamphlets were printed by AFRILAW project team and would in turn be disseminated at the four 1-Day PSC Regional Sensitization Workshop on Private Security and 2023 Elections in Nigeria in 3 States.

  • CSOs Training Workshop on Private Security and 2023 Elections Monitoring:

A 1-Day CSOs Training Workshop on Private Security and 2023 Elections Monitoring was held on February 16th 2023 at Topview Hotel, FCT-Abuja for 10 selected CSOs Representatives who are Nigeria members of CSOs Pillars of ICoCA and Private Security Governance of DCAF. The CSOs representatives includes COMPPART Foundation; New Nigeria Foundation; AFRILAW; Council for Affirmative Action (COFAA); LITE-Africa; Centre for Environment, Human Rights and Development (CEHRD); Centre for Human Rights and Social Advancement (CEFSAN); Children and Young People Living in Peace (CYPLP); Keen and Care Initiative and Centre for Mmadu on Human Rights.

  • CSOs Monitoring and Assessment of Private Security Services During 2023 Elections in Nigeria: 

The aim and objective of the exercise is to monitor and assess private security services and election policymakers and stakeholders’ use of private security before, during and after the 2023 elections including private security compliance with the Resolution for Good Private Security Governance during the 2023 Election in Nigeria. The trained 10 CSOs representatives were hired and engaged by AFRILAW to carry out the monitoring and assessment exercise in 10 States of Nigeria. Both qualitative and quantities methodology were used for data collection during the CSOs monitoring and assessment exercise. The States for the CSOs Monitoring and Assessment were: FCT/Abuja; Anambra State; Enugu State; Lagos State; Kaduna State; Kano State; Bauchi State; Akwa Ibom State; Delta State and Rivers State. ICoCA provided funding for 6 CSOs engagement and DCAF provided for 4 CSOs. 

  • Regional Sensitization Workshop on Private Security and 2023 Elections in Nigeria:  

The key objective of this workshop is to sensitize private security companies on the roles and importance of private security service in the electoral process in Nigeria and the Good Private Security Governance and Practices during elections in Nigeria.

The workshop had in attendance about 42 participants including NSCDC representatives and 20 PSCs representatives.  The printed copies of the adopted Resolution on Good Private Security Governance during 2023 Election in Nigeria were used for the Regional Sensitization Workshop for the PSCs and were presented to the PSCs representatives during the workshop.

  • Production and Printing of Monitoring Report on Private Security and 2023 Elections in Nigeria:

The data collected from the CSOs Monitoring and Assessment of Private Security Services During 2023 Elections in Nigeria in 10 States were analyzed and developed by AFRILAW. The CSOs Monitoring and Assessment Report were printed and was used for the 1-Day National Stakeholders Forum and Public Presentation of Report of Monitoring and Assessment of Private Security Services During 2023 Elections in Nigeria. About 700 copies of the CSOs Monitoring and Assessment Report to be disseminated among the election and private security policymakers and stakeholders in Nigeria.

Key Results and Achievements:

  • The implementation of the first ever project on participation and engagement of PSCs in electoral process in Nigeria
  • Increased election and private security policymakers and stakeholders’ awareness and general support for official participation and engagement of PSCs in electoral process in Nigeria
  • The active participation of key election security policymakers and stakeholders especially the Independent National Electoral Commission (INEC) and Office of the National Security Adviser to the President (ONSA) who are the Co-Chairs of the Inter-Agency Consultative Committee on Election Security (ICCES).
  • The public support and recommendation of PSC official engagement and participation in electoral process in Nigeria by INEC and Office of the National Security Adviser to the President (ONSA).
  • INEC and Office of the National Security Adviser to the President (ONSA) Representative requested that the NSCDC and ALPSPN should approached them for discussion on the process and modalities for formal engagement of PSC in elections in Nigeria.
  • About 100 PSCs Representatives were trained and sensitized on Good Private Security Governance during 2023 Election in Nigeria and actively participated in the project activities.
  • The adoption, production and dissemination of the Resolution on Good Private Security Governance during 2023 Election in Nigeria and their use for the Regional Sensitization Workshops for the PSCs.
  • The conduct of the first ever monitoring and assessment of private security services during elections in Nigeria
  • The CSOs monitoring and assessment of private security services during 2023 elections in Nigeria in 10 states in Nigeria and the production of the monitoring and assessment report and its public presentation and dissemination to policymakers and stakeholders.

STRENGTHENING PRIVATE SECURITY REGULATION AND OVERSIGHT IN NIGERIA PROJECT 

 (2020-2021)

About the Project: AFRILAW in partnership with the Geneva Centre for Security Sector Governance (DCAF) in collaboration with the Private Security Governance Observatory and in partnership with the Nigeria Security and Civil Defence Corps (NSCDC) and the Association of Licensed Private Security Practitioners of Nigeria (ALPSPN) is implementing the “Strengthening Private Security Regulation and Oversight in Nigeria Project”. The Project commenced in August 2018, with a Baseline Study on Private Security Governance in Nigeria, which tried to get the true position of the private security situation in Nigeria. This study took place in August 2018 –June 2019. Springing from the finding of the study, in 2020 AFRILAW and its partners began to engage using a multi-stakeholder approach to strengthen the governance of private security industry. 

PROJECT ACTIVITIES FOR 2020:

  • PRIVATE SECURITY GOVERNANCE FORUMS (PSGF) IN THE SIX GEO-POLITICAL ZONES OF NIGERIA

AFRILAW organized across the six geo-political zones of Nigeria Private Security Forum. The Forum was a platform for private security stakeholders to discuss challenges and opportunities in private security governance and the ways to strengthen it. The Forum aimed at sensitizing stakeholders of the present state of the Private Security industry in Nigeria, bringing to their notice some international good practices relevant to the industry i.e.the Montreux Document and the International Code of Conduct for Private Security Providers (ICoCA) and providing a platform for all stakeholders to discuss the various challenges, opportunities and the way to strengthen the sector from their various perspectives.

The South-East Private Security Governance Forum held in Enugu State on the 24th of September, 2020 at Hotel Fidelma, Enugu. Representatives from Nigeria Security Actors including the Nigeria Police Force, Nigeria Army, Nigeria Security and Civil Defense Corps, Department of State Security etc; civil society organizations committed to security sector reforms, relevant business groups/associations & private security companies’ clients, private security companies, etc, attended the Forum.

  • SOUTH-SOUTH PRIVATE SECURITY GOVERNANCE FORUM (PSGF):

The South-South private security governance forum held in Port Harcourt, Rivers State Nigeria, on 15th of October 2020 at Aldgate Congress Hotels, Port Harcourt. The program was chaired by the state Commandant of the Nigeria Security and Civil Defense Corps. Other military and para-military agencies like the Nigeria Police Force, the Nigeria Army, Department of State Security, etc were fully represented. 

Also Civil Society Organizations, media and members of the Association of Private Security Practitioners of Nigeria (ALPSPN) were also represented.

  • NORTH-WEST PRIVATE SECURITY GOVERNANCE FORUM (PSGF): 

The North-West Private Security Governance Forum held at Porte Golf Hotel, Kano State. The Forum saw the attendance of officials of the Nigeria Security and Civil Defense Corp, especially the Comptroller General Nigeria Security and Civil Defense Corp; the Nigeria Police Force, Nigeria Army, Department of State Security etc. various CSOs whose thematic focus is hinged on security sector reform attended the forum. Private Security Companies were present at the program.

A multi-stakeholder approach was adopted, where stakeholders discussed all the issues surrounding the private security industry, the challenges, opportunities and the way forward. The North-West PSG forum held on Thursday 5th November, 2020. 

  • NORTH-EAST PRIVATE SECURITY GOVERNANCE FORUM (PSGF):

The North-East Private Security Governance (PSG) Forum held at Bauchi State, Yimir Hotels and Suites. The Forum adopted a similar approach i.e. the multi-stakeholder approach where government security agencies like the Nigeria Police Force, the Department of State Security, etc, Civil Society Organizations, Private Security Companies and the Media, discussed the state of, challenges and opportunities of the private security industry. The State Chairperson, National Human Right Commission Chaired the event on the 26th November, 2020.

  • NORTH-CENTRAL PRIVATE SECURITY GOVERNANCE FORUM (PSGF):

The North-Central PSG Forum Held on the Wed. 9th of December, 2020 at the Topview Hotel, Abuja. Participants from the Nigeria Correctional Service, Nigeria Police Force, Nigerian Army, Nigeria Security and Civil Defence Corps (NSCDC), Nigeria law reform commission; Ministry of Justice; CSOs, association of private security practitioners, media etc, were present at the Forum.

  • PROJECT ACTIVITIES NO.2: ONE-DAY RADIO PHONE-IN SESSIONS

In furtherance of the objectives of the project which one of it is improved knowledge and capacity of key stakeholders, the project set out to do a radio assessment and sensitization program. The aim of the radio phone-in program is to access the extent of knowledge that the public within the reach of the radio have about private security issues in Nigeria, to sensitize the public within the reach of the organization on Private Security Governance issues within the region and finally to raise awareness on the Forum which in all the cases was to happen the next day. 

The radio talk show was carried out in the six geo-political zones just as the Private Security Governance Forum. 

South-East Radio Phone-in Program: The South-East radio phone-in session held at Dream 92.5 FM on 23rd of September, 2020. AFRILAW’s ED, the HOD Private Guards Department, Nigeria Security and Civil Defense Corp and the State Chairperson, Association of License Private Security Practitioners of Nigeria (ALPSPN), Enugu Chapter anchored the radio program and discussed issues surrounding Private Security Governance in Nigeria generally and in the region. South-South Radio Phone-in Program: The South-South radio program held on 14th of October 2020 at Nigeria Info fm, 92.3fm. A robust discussion on the regulation of Private Security Governance and the peculiarities surrounding same in the region took place during the radio discussions.The Zonal Coordinator ALPSPN, HOD Private Guards Department, Nigeria Security and Civil Defense Corp (NSCDC), Port Harcourt, and AFRILAW ED, anchored this.

  • PROJECT ACTIVITIES NO. 3: NIGERIA MONTREUX DOCUMENT (MD) AND INTERNATIONAL CODE OF CONDUCT FOR PRIVATE SECURITY PROVIDERS (ICOCA) ROUNDTABLE

AFRILAW organized a Roundtable for all key government ministries, departments and agencies in the private security industry to bring to their notice international good practices relevant to Private Security Governance i.e. the Montreux Document and the International Code of Conduct for Private Security Providers (ICoCA). The objective of the Roundtable was to improve the governance of Private Security in Nigeria and to do this by carrying out advocacy to Nigeria policy makers to join the Montreux Document Forum and the International Code of Conduct Association thereby institutionalizing good practices in the industry. The Roundtable held on the 8th of December 2020 at the TopView Hotel, Wuse Abuja.Representatives from the Nigeria Law Reform Committee, the German Embassy, Swiss Embassy, Nigeria Bar Association, Administration of Criminal Justice Monitoring Committee (ACJMC), Nigeria Police Force, Nigeria Law Reform Commission (NLRC), and Association of Licensed Private Security Practitioners of Nigeria, CSOs and Media attended the event.

  • PROJECT ACTIVITIES NO.4: CONFERENCE FOR CIVIL SOCIETY ORGANIZATION:

As part of its commitment to fulfilling the objective of the project through a multi-stakeholder engagement, AFRILAW and its partners hosted a civil society conference to sensitize CSOs on the peculiarities surrounding private security governance in Nigeria. The main objective of the conference was to achieve greater participation of CSOs in the advocacy for a better private security framework in Nigeria. This first CSO Conference on private security governance hosted over fifteen CSOs selected from across the six geo-political zones of Nigeria, at the TopView Hotel, Abuja on the 7th of December 2020.

  • PROJECT ACTIVITIES NO.5: NIGERIA PRIVATE SECURITY INDUSTRY LAW REVIEW:

In furtherance of the goal to strengthen Private Security Governance, AFRILAW and DCAF provided support to the Nigeria Security and Civil Defense Corp (NSCDC), to review the industry bill. AFRILAW ED was nominated as part of the Law Review Committee.

AFRILAW did the following:

  • Became a member of the law review committee
  • Attended the briefing by the Commandant General of the Security and Civil Defense Corp (NSCDC)
  • Participated in the various drafting session 
  • Provided both financial and technical support.
  • Brought to the attention of the drafting team provisions of international good practices relevant to the industry i.e. the Montreux Document (MD), and the International Code of Conduct (ICoCA).  

The goal of reviewing and redrafting the proposed bill was to ensure that its provisions carter for the rising security challenges and provides proper regulation for the industry. The Committee had various sessions to review the law

THE PROJECTS ACTIVITIES IN 2021

  • CONFERENCE CALL AND TRAINING OF MEDIA REPRESENTATIVE

In 2020, six local experts (Civil Society Organizations) were recruited, representing each of Nigeria’s six regions, to compile and crystallize the local discussion and peculiarities in the operations of private security practitioners in their regions and to discuss their findings at the national level during the Montreux Document Forum and International Code of Conduct Association Roundtable at Abuja in December 2020. The testimonies of the local experts was summarized and compiled to produce a guide for CSO in their engagement with private security industry. 

However, in this tool guide produced by DCAF, there was a need to incorporate Media perspective in the tool. For this reason four (4) Media representatives were selected to provide their own experiences and input into the tool to make sure that the tool also reflected the specific needs and challenges encountered by the media when dealing with private security actors and activities. 

AFRILAW held a Conference Call and Training for Media Representatives on the Relevance of International Best Practices in Nigeria: Media’s Perspective in partnership with DCAF on Wednesday June 23, 2021. 

The aim of the programme was to train (4) Media representatives selected to provide their own experiences and challenges into the draft tool to make sure that the tool also reflects the specific needs and challenges encountered by the media when dealing with private security actors and activities.

  • CIVIL SOCIETY ORGANIZATIONS DRAFT TOOL REVIEW VIRTUAL WORKSHOP

AFRILAW in partnership with DCAF organized the Civil Society Draft Tool Review Virtual Workshop on Private Security Governance Challenges and The Relevance of International Best Practices: A Practical Guide for Civil Society and Media on Wednesday September 8, 2021. About 35 CSOs participated in the Virtual Workshop held through the Zoom Platform.

The aim of the Virtual Workshop was to bring together Nigerian civil society organisations to gather their feedback on the draft tool: “Private security governance challenges and the relevance of international best practices – A PRACTICAL GUIDE FOR CIVIL SOCIETY AND MEDIA”, to ensure that this new publication will be updated, accurate and useful. Moreover, the soft copy of the Draft Tool was earlier sent to the CSOs for review toward the event. 

  • MEDIA DRAFT TOOL REVIEW VIRTUAL WORKSHOP

The Media draft tool Review Virtual Workshop was organized by AFRILAW and DCAF bringing together 4 Nigerian Media Representatives to gather their feedback on the draft tool. The program therefore discussed “Private Security Governance Challenges and the relevance of international Best Practices-A PRACTICAL GUIDE FOR CIVIL SOCIETY AND MEDIA”, to ensure that the new publication will be updated, accurate and relevant in the Nigerian context. This Virtual Workshop was held on September 17, 2021. 

  • MDAS CONSULTATIVE MEETING FOR NIGERIA TO JOIN THE MONTREUX DOCUMENT FORUM (MDF) AND THE INTERNATIONAL CODE OF CONDUCT ASSOCIATION (ICOCA)

AFRILAW in partnership with NSCDC, with support from Geneva Center for Security Sector Governance (DCAF) Switzerland held an MDAs Consultative Meeting for Nigeria to join the Montreux Document Forum (MDF) and the International Code of Conduct Association (ICoCA) on Thursday October 14th, 2021 at Madam Janet Hall, Topview Hotels, Abuja. 

The aim of the Consultative Meeting is to brief the key MDAs of the Federal Government on the importance of Nigeria becoming a member of the Montreux Document Forum (MDF) and the International Code of Conduct Association (ICoCA) initiatives and to get their support in this regard. There was about 15 representatives from the various MDAs who participated in the meeting.

  • 1-DAY TRAINING WORKSHOP ON DEVELOPMENT OF PRIVATE SECURITY COMPANIES PROCUREMENT POLICY

 

AFRILAW in collaboration with LITE-AFRICA and in partnership with DCAF and ICOCA held a training workshop on the Development of Private Security Companies Procurement Policy on Thursday October 21st, 2021 at Aldgate Congress Hotels, Port-Harcourt, Rivers State.  There was about 30 participants representing diverse clients and users from companies, organizations and estates in Port-Harcourt, Rivers State.

The 1-Day Training Workshop is aimed at assisting selected companies especially those working in the extractive sector/region to review and developed an international standard Private Security Company Procurement Policy used in hiring of private security company services.  

 

  • 1-DAY TRAINING WORKSHOP ON REVIEW AND DEVELOPMENT OF INTERNAL DOCUMENTS OF PRIVATE SECURITY COMPANIES

AFRILAW, DCAF, and ICoCA in collaboration with the Association of Licensed Private Security Providers of Nigeria organized a 1-Day Training Workshop on Review and Development Of Internal Documents of Private Security Companies on Friday October 22, 2021 at Aldgate Congress Hotels, Port Harcourt, Rivers State, There was about 55 participants including about 45 private security companies.

The free 1-Day Training Workshop aimed at assisting selected Private Security Companies to improve and strengthen their internal management and operational system for organizational development, effectiveness and responsible service delivery in Nigeria.

  • THE PRIVATE SECURITY GOVERNANCE CHALLENGES AND THE RELEVANCE OF INTERNATIONAL NORMS AND BEST PRACTICES: CAPACITY BUILDING WORKSHOP FOR CSOS AND MEDIA

 AFRILAW in partnership with DCAF convened the capacity building workshop for CSOs and Media with the theme: “private security governance challenges and the relevance of International norms and best practices” in November the 16th, 2021 at the Madam Janet Hall, Topview Hotel, Abuja. About 50 CSOs and Media representatives who participated in the workshop including ACG-PGC and his entourage who visited as a Special Guest. 

 The Toolkit was developed to empower a strong and informed civil society and media:  with the aims of providing updated information on the various challenges linked with private security companies’ activities in Nigeria, with detailed overview for each of the six geographical regions of the country; and providing guidance to CSOs and media on international norms and best practices. The guide draws on the three main source of international norms and good practices for the good governance of PSCs namely the International Code of Conduct for Private Security Service Providers (the Code), the Montreux Document on Private Military and Security Companies and the Voluntary Principles on Security and Human Rights (VPs).  

 

  • PUBLIC PRESENTATION/LAUNCHING EVENT OF THE TOOLKIT: “PRIVATE SECURITY GOVERNANCE CHALLENGES AND THE RELEVANCE OF INTERNATIONAL NORMS AND BEST PRACTICES: A GUIDE FOR CIVIL SOCIETY AND MEDIA”

The Public Presentation/Launching Event of the Toolkit: “Private Security Governance Challenges and the Relevance of International Norms and Best Practices: A Guide for Civil Society and Media” was held on Wednesday 17th of November, 2021  at Madam Janet Hall, TopView Hotel, Wuse Zone 5, Abuja. There were about 70 participants covering representatives from federal government security, justice and human rights agencies, CSOs/NGOs/INGOs and Media, ALPSPN and PS industry and Swiss Embassy. The event was chaired by the Commandant General of the NSCDC ably represented by Assistant Commandant General Private Guard Company (ACG-PGC).

The Toolkit was developed to empower a strong and informed civil society and media:  with the aims of providing updated information on the various challenges linked with private security companies’ activities in Nigeria, with detailed overview for each of the six geographical regions of the country; and providing guidance to CSOs and media on international norms and best practices. The guide draws on the three main source of international norms and good practices for the good governance of PSCs namely the International Code of Conduct for Private Security Service Providers (the Code), the Montreux Document on Private Military and Security Companies and the Voluntary Principles on Security and Human Rights (VPs).  

The toolkit designed as a guide for CSOs and media and had being reviewed by both groups was presented at the National level on the 17th of November, 2021. The public launch and presentation of the toolkit saw the participation of various CSOs and Media organization, representative of the Inspector General of Police, the representative of the minister of interior, National human right Commission, Nigeria Security and Civil Defence Corp (NSCDC) and other MDAs. The Tool was developed to ensure proper private security governance and responsible services in Nigeria and the toolkit will help the stakeholders to understand this and promote the same. At the event, the need for active CSOs and Media engagements in promoting private security governance and responsible private security services using the Toolkits was emphasised.

  • ADVOCACY VISITS AND MEETINGS UNDER THE PROJECT

There were a series advocacy visits and meetings by the AFRILAW ED with various private security industry policymakers, regulator and key stakeholders within the period of April to September 2021. The advocacy visits and meetings are as follows:

  • Advocacy Visit And Meeting With Swiss Deputy Ambassador On April 20, 2021:

As part of the efforts to get Nigeria government’s interest in joining Montreux Document Forum and International Code of Conduct Association (ICOCA), AFRILAW ED submitted a request for advocacy visit and meeting with a proposal for Nigeria to Join MDF and ICOCA on December 2020 and March 2021 respectively to the Honourable Minister of Interior, as Ministry of Interior is the supervising ministry of NSCDC, and to the Commandant General of NSCDC, as NSCDC is the private security regulatory authority in Nigeria. Based on our request the Minister of Interior invited AFRILAW ED and Swiss Federation Ambassador in Nigeria for a meeting on May 6, 2021, and in preparation for the meeting with the Honourable Minister of Interior by the Swiss Ambassador, Swiss Deputy Ambassador invited AFRILAW ED for briefing on what AFRILAW is doing in this regard and discussion for better understanding of the proposed visit and meeting with Honourable Minister of Interior.

The meeting between AFRILAW and Swiss Deputy Ambassador took place on Tuesday April 20, 2021 at the Swiss Embassy, Abuja. Mr. Tunde Ajala, the Senior Economic and Political Adviser of Swiss Embassy was also present at the meeting.

AFRILAW ED used the opportunity to introduce himself, AFRILAW and its activities to the Swiss Deputy Ambassador particular the DCAF project with AFRILAW in Nigeria on private security governance. He explained in detail the various aspects of the project including the results and impacts recorded. He further explained about the programme and agenda of getting Nigeria government joining Montreux Document Forum and International Code of Conduct Association (ICOCA) and AFRILAW efforts so far and the need for Swiss Embassy support in this regard.

There was a lot discussion on the subject matter with various questions and disagreement on why Swiss Embassy should be support the effort from the Swiss Deputy Ambassador. Key 

Key Results/Opportunity: It was a great opportunity for AFRILAW to get introduced to Swiss Deputy Ambassador and brief him on the various project activities been implemented on private security governance in partnership with DCAF.

  • Advocacy Visit And Meeting With Swiss Deputy Ambassador To CG of NSCDC On May 06, 2021

Following some pressures from the DCAF HQ and Swiss Foreign Affairs, the Swiss Deputy Ambassador accepted to join AFRILAW ED for an advocacy visit and meeting with the new Commandant General of NSCDC on Thursday May 6, 2021. Moreover, the advocacy and meeting with the Honourable Minister of Interior by the Swiss Ambassador was cancelled because of non-availability of the Swiss Ambassador within the time. AFRILAW ED, the Swiss Deputy Ambassador and Mr. Tunde Ajala visited the CG of NSCDC as scheduled. Our team was warmly welcomed by CG with the company of ACG-PGC, Mrs Helen Amakiri. The CG is his welcome remark appreciated the visit and the efforts of the Swiss government via the Embassy in promoting peace and security in Nigeria. He also appreciated the AFRILAW for partnership with the NSCDC and the works they are doing with the PGC department in advancing private security governance in Nigeria.

In his speech, the Swiss Deputy Ambassador congratulated the CG on his recent appointment as the CG of the NSCDC and assured him of the Swiss Embassy support and partnership with the NSCDC in fulfilling their mandate. He explained the reason for the visit and solicited for the support of the CG toward ensuring that Nigeria government joined the MDF, ICOCA and the VPs initiatives. He later presented a gift to the CG of NSCDC.

 

AFRILAW ED also spoke about the key benefits of Nigeria joining the 3 initiatives and AFRILAW efforts in this regard, and called on the CG to take the lead in this process and ensure that Nigeria joined the initiatives. He thereafter presented copies of the MDF and ICOC to the CG. In his response, the CG appreciated the efforts of the AFRILAW and Swiss Embassy in promoting that Nigeria should join the 3 initiatives. He acknowledges the benefits of Nigeria membership of the initiatives and promised to consider the request of supporting and promoting the cause.

Key Results/Opportunity: This was a great opportunity to get introduced and acquitted with the new CG and lay foundation for future partnership in AFRILAW work with the NSCDC.

  • Advocacy Visit And Meeting With NSCDC ACG-PGC and DLS On July 27, 2021

Following the redeployment of former ACG-PGC, Mrs Helen Amakiri, and appointment of the new ACG-PGC Mr, Raji Ibrahim, it became imperative for AFRILAW ED to introduced AFRILAW to him and briefs him on our various project activities. The advocacy visits and meeting was held on July 27 at the NSCDC HQ, Abuja. AFRILAW ED used the opportunity to explain all the project activities with the former ACG-PGC and highlighted the various achievements and results recorded to the new ACG-PGC. He solicited for his support and partnership with AFRILAW going forward.

In his response, the new ACG-PGC expressed his delight in the existing partnership between AFRILAW and NSCDC particularly the PGC Department. He appreciated AFRILAW for the various projected implemented in partnership with NSCDC since 2019. He greatly thanked DCAF for their support in this regard. He pledged his support to AFRILAW and DCAF and expressed his willing to continue the partnership between AFRILAW and PGC Department in advancing the development of the private security industry in Nigeria.

Also, AFRILAW ED has a meeting with the Director of Legal Services of NSCDC, Mr. Umar Mohammed were they discussed the efforts in getting Nigeria join the MDF and ICOCA and seeking the DLS support in this regard. The DLS after appreciating the efforts of AFRILAW and their works in partnership with NSCDC, and he pledged to support AFRILAW in all their programmes and activities with the NSCDC.

Key Results/Opportunity: The willingness of the new ACG-PGC to support and continue partnering with AFRILAW in its works with DCAF in advancing private security governance in Nigeria. The support of the DLS is paramount in ensuring AFRILAW success in its works with NSCDC.

  • Advocacy Visit And Meeting With NSCDC CG and ACG-PGC On August 17, 2021

Based on a successful advocacy visits and meetings between AFRILAW ED, Swiss Deputy Ambassador and new CG, and between AFRILAW ED and the new ACG-PGC, and as way of following up some key agreement during the visits, AFRILAW ED resubmitted the proposal for Nigeria to join the MDF and ICOCA and NSCDC to lead the efforts in this regard to the new CG of the Nigeria. The submission of the proposal brought about the call for a visit for a meeting with the new CG for further discussion and clarification on the subject matter.

AFRILAW ED and ACG-PGC had a meeting with the CG of NSCDC on the proposal for Nigeria to join MDF and ICOCA and the need for NSCDC to lead in advancing the process.  AFRILAW ED used the opportunity to explain in details in key benefits of membership of 2 initiatives to Nigeria and to NSCDC in particular. The CG expressed a doubt about the need for NSCDC to lead the process and represent Nigeria in the 2 initiatives. In particular, he was of the view that NSCDC does not need to be part of ICOCA with the same companies they are regulating. However, AFRILAW ED presented a good clarification on the CG’s concern by explaining the 3 Pillars of ICOCA, their functions and benefits to Pillar members.

After the clarification, the CG showed an understanding of the concept of the ICOCA 3 Pillars, and thereafter accept the proposal and expressed his support and interest for NSCDC to work toward ensuring Nigeria membership of the 2 initiatives. However, He maintained that they can only work on the proposal after obtaining the authorisation and approval from the Federal Ministry of Interior, their supervising ministry. He later instructed us to meet with his PA who should draft a Memo to the Honourable Minister of Interior seeking for his authorisation and approval for NSCDC to initiate the process of joining the membership of the 2 initiatives.

Thereafter, AFRILAW ED and ACG-PCG had a meeting with the CG’s PA on drafting of a Memo to Honourable Minister of Interior seeking for his authorisation and approval for NSCDC to initiate the process of joining MDF and ICOCA. AFRILAW ED used the opportunity to explain in details the proposal and the need for Nigeria to join the 2 initiatives and expectations from the NSCDC. The PA to the CG expressed his delight about the proposal and pledged his support to it and promised to work on the Memo together with the ACG-PGC.

Key Results/Opportunity: Provision of good clarification to the CG on the 3 Pillars of ICOCA by AFRILAW ED, and subsequent expression of support and interest by the CG of NSCDC to lead in the efforts for Nigeria to join MDF and ICOCA, and initiation of the process of obtaining the required authorization and approval from the Honourable Minister of Interior in this regard.

  • Advocacy Visit And Meeting With Central Executive Members Of The ALPSPN On September 2, 2021

Following a yearlong advocacy engagement with the national leadership of the ALPSPN, AFRILAW ED was invited to meet with the members of the Central Executive of the Association during their meeting at their National Secretariat, Abuja on September 2, 2021. The Central Executive of the ALPSPN is made up of all the National Executives and all the State Chairmen of State Chapters of the Association. The aim of the visit and meeting with the Central Executive is to formally introduce AFRILAW and its activities to the Association and explore opportunity for partnership between AFRILAW and ALPSPN in advancing development of private security industry in Nigeria and implementing AFRILAW project activities in advancing private security governance and responsible private security services in Nigeria. 

During the meeting AFRILAW ED, was introduced to the Central Executive members by the National President of the Association, and he was later given opportunity to address the central executive members. AFRILAW ED started by appreciating them and the great efforts of the leadership of the association in promoting the development of the industry. He gave them an overview of AFRILAW and its project activities in Nigeria in partnership with DCAF and NSCDC. He also introduced ICOCA to them and implored them to register and become a member of the Association. The advocacy for Nigeria to join the membership of MDF and ICOCA was also put forward by the ED. He used the opportunity on seek for opportunity for formal partnership between AFRILAW and ALPSPN. 

After the presentation from the AFRILAW ED, there was a Q and A Session where the members seek for more understanding on the work of DCAF and ICOCA and the opportunity to their members. How AFRILAW project activities in Nigeria can directly benefit the Association and members. AFRILAW ED answered the questions and gave clarification to their concerns.

  • SIGNING OF MEMORANDUM OF UNDERSTANDING (MOU) BETWEEN AFRILAW AND ALPSPN: 

On the 2nd Day of the Central Executive members meeting, that is on September 3, 2021, the AFRILAW ED and ALPSPN National President signed a Memorandum of Understanding (MOU) between AFRILAW and ALPSPN for partnership and collaboration for technical support and services in Nigeria for an initial period of 2 years subject to renewal. The purpose of this MOU is to establish the terms and conditions for strategic partnership and collaboration for provision of technical support and services to the ALPSPN and its members by AFRILAW and its partners toward an improved and effective private security services and development of private security industry in Nigeria.

Under the MOU, AFRILAW has the responsibilities of facilitating and providing technical support, professional development and capacity-building services for improved and effective management and operational standards, and compliance with the code of conducts, ethics and human rights and professional standards for ALPSPN and its members in Nigeria. 

The responsibilities of ALPSPN under the MOU include facilitating, mobilizing and ensuring active participation, support and cooperation of ALPSPN and its members and provision of necessary resources as may be required for a successful provision of technical support, professional development and capacity-building services by AFRILAW and its technical partners.

  • SIGNING OF FRAMEWORK AGREEMENT BETWEEN ALPSPN, DCAF AND AFRILAW:

Also, on September 3, 2021 the National President of the APSPN signed the Framework Agreement between ALPSPN, DCAF and AFRILAW for Training on International Good Practices for Private Security Companies in Nigeria Programme.

In signing this Framework Agreement, the Parties agreed to work together in a spirit of mutual learning and cooperation in order to jointly develop and promote international norms good practices regarding private security governance in Nigeria. The Framework Agreement sets forth the general terms and conditions under which the Parties agree to cooperate. Agreement of individual activities, including allocation of specific roles and responsibilities, budgets and timelines will be done on a case by case basis. 

The scope of cooperation under the Framework Agreement includes the following areas of activity: 

  • Review and update the code of conduct of ALSPN 
  • Develop a curriculum for an executive training for ALSPN members 
  • Organization of a pilot training 
  • Promotion and application of the value of the Montreux Document and International Code of Conduct.

Key Results/Opportunity: The successful signing of an MOU between AFRILAW and ALPSPN for partnership and collaboration for technical support and services in Nigeria; and National President of APSPN signing of the Framework Agreement between ALPSPN, DCAF and AFRILAW for Training on International Good Practices for Private Security Companies in Nigeria Programme.

BASELINE STUDY ON PRIVATE SECURITY GOVERNANCE IN NIGERIA PROJECT

 (2018-2019)

About the Project: AFRILAW in partnership with Private Security Governance Observatory and Nigeria Security and Civil Defense Corps (NSCDC) with funding from the Geneva Center for Security Sector Governance (DCAF), Switzerland is implementing the Baseline Study on Private Security Governance in Nigeria Project. The Project aim is to conduct a Study on the situation of private security governance and operations, to identify areas of challenges and to develop and promote an advocacy strategy for private security reform in Nigeria. The objectives include reviewing the existing legal and regulatory frameworks for private security providers’ governance in Nigeria; examining the standards of operations and practices of private security providers in Nigeria; and improving stakeholders’ engagement and advocacy for private security reform in Nigeria. The baseline study is been carried out in two (2) selected Local Government Areas (LGAs) in Abuja/FCT and Rivers State. The Project areas represent a State from the Southern region (Rivers State) and Northern region (Abuja/FCT) of the country. The Project started in August 2018.

THE PROJECT ACTIVITIES IN 2018:

The Research Team Training Workshop was held at Lapour Hotel, Abuja on  November  20,  2018.  AFRILAWs ED is a Steering  Committee member of the Private  Security Governance  Observatory, and a registered official CSO partner of Nigeria Security and Civil Defense Corps (NSCDC).

PROJECT ACTIVITIES IN 2019:

    • Field Work and Data Collection: Data Collection was carried out by the trained Data Collectors in two (2) selected Local Government Areas (LGAs) in Abuja/FCT and Rivers State. The Project areas represent a State from the Southern region (Rivers State) and Northern region (Abuja/FCT) of the country using qualitative and quantitative methodologies. Also, a secondary data were collected from researched publications, seminar and workshop papers and all other available publications on PSCs in Nigeria and globally. Official and public records from governmental agencies, like the NSCDC and the Nigeria Bureau of Statistics.
    • Data Management & Analyses: AFRILAW hired a Data Analyst to process and analyze the collected data. Analysis was done using descriptive statistics which include the use of frequencies, percentages, and mean for relevant variables. Tabular and graphical data presentations was employed.
    • Development, Review and Publication of Baseline Study Report: AFRILAW hired a Consultant to develop a draft Baseline Study Report which was reviewed in partnership with DCAF, and the final Report published for public presentation and launching.
    • Baseline Study on Private Security Governance in Nigeria Report Launch Event: 

The Baseline Study on Private Security Governance in Nigeria report was launched on August 8th, 2019 at Top View Hotel, Abuja by African Law Foundation (AFRILAW) in collaboration with Private Security Governance Observatory and Nigeria Security and Civil Defense Corps (NSCDC) with support from Geneva Center for Security Sector Governance (DCAF). There were representatives from NSCDC, Nigeria Police Force (NPF), Nigeria Immigration Service (NIS), Association of Licensed Private Security Practitioners of Nigeria (ALPSPN), Nigeria Bar Association (NBA), CSOs/NGOs, Private Security Companies, Federal Ministry of Justice and Media Organizations at the event.
